Welcome to DiffusionSMB (“DiffusionSMB,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website located at https://diffusionsmb.com (the “Site”), and any related services, content, tools, demos, or communications we provide, including SMS/text messaging communications (collectively, the “Services”).

By accessing or using the Site or Services, submitting a form on the Site, booking a demo or consultation, or otherwise opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or Services.

Agreeing to these Terms, submitting a form, providing a telephone number, or booking a demo or consultation does not by itself constitute consent to receive SMS messages. SMS consent is requested separately through an optional checkbox that is unchecked by default. Users may complete a booking without consenting to SMS messages.

     

      1. Who We Are

    DiffusionSMB provides AI-powered receptionist, lead capture, appointment scheduling, and customer follow-up tools designed for small and medium-sized businesses. Through the Site, visitors can learn about our services, request information, and book demos or consultations with our team.

       

        1. Eligibility

      You must be at least 18 years old, and have the legal authority to enter into these Terms on your own behalf or on behalf of the business you represent, to use the Site or Services.

         

          1. Use of the Site and Services

        You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to:

           

            • Use the Site or Services in any way that violates applicable federal, state, local, or international law or regulation;

            • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;

            • Interfere with or disrupt the operation of the Site or Services, or the servers or networks used to make the Site or Services available;

            • Use any automated means (bots, scrapers, or similar) to access the Site for any purpose without our express written permission;

            • Submit false, misleading, or fraudulent information through any form on the Site, including demo requests or consultation bookings;

            • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

             

              1. SMS / Text Messaging Program Terms

            If you provide your mobile phone number and affirmatively opt in (for example, by checking a consent box when booking a demo or consultation), you agree to receive text messages (“SMS”) from DiffusionSMB related to appointment scheduling, appointment reminders, demo confirmations, rescheduling, service updates, and customer support follow-up. These messages are transactional/informational in nature and are not marketing messages.

               

                • Consent: Consent to receive SMS messages is not a condition of purchasing any goods or services. You may opt in by checking the applicable consent checkbox on our forms.

                • Message Frequency: Message frequency varies based on your interactions with us (e.g., number of scheduled appointments or support inquiries).

                • Message and Data Rates: Message and data rates may apply based on your mobile carrier plan. DiffusionSMB is not responsible for any charges from your wireless carrier.

                • Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, or STOPALL to any message. After opting out, you will receive one final confirmation message and no further messages, unless you opt back in.

                • Help: For help, reply HELP or INFO to any message, or contact us at info@send.diffusionsmb.com.

                • Carriers: Carriers are not liable for delayed or undelivered messages. Supported carriers are not guaranteed and are subject to change.

                • Changes to Your Number: If you change or deactivate your mobile phone number, you agree to promptly update your account information or notify us to prevent messages from being sent to the new owner of your former number.

              Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Please see our Privacy Policy for more information on how we collect, use, and protect your information.

                 

                  1. Demos, Consultations, and Future Services

                DiffusionSMB currently offers informational content, demo bookings, and consultations through the Site. We do not currently process payments or sell subscriptions directly through the Site. If and when we begin offering paid products or services, additional terms governing billing, fees, cancellations, and refunds will be presented to you at the time of purchase and will supplement these Terms.

                   

                    1. Intellectual Property

                  All content on the Site, including text, graphics, logos, images, software, and the compilation thereof, is the property of DiffusionSMB or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to use the Site and Services for their intended purpose.

                     

                      1. Third-Party Links and Services

                    The Site may contain links to third-party websites or services that are not owned or controlled by DiffusionSMB. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of any third-party site is at your own risk and subject to that third party’s terms.

                       

                        1. Disclaimers

                      THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

                         

                          1. Limitation of Liability

                        TO THE FULLEST EXTENT PERMITTED BY LAW, DIFFUSIONSMB AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

                            These Terms and any dispute arising out of or related to them or the Services will be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.
